User Agreement

Introduction

Please read this User Agreement (“Agreement”) before using SmartTourist. It governs your relationship with Smart-Tourist Kazakhstan LLP. Any download, installation, launch, or use of the app means you accept the current version.

3. License Grant

3.1. SmartTourist is software for mobile devices.

3.2. Applies to iOS and Android. Requirements: iOS 12.0+; Android 6.0+. We provide a non-exclusive license to download, install, run, and use the app in line with this Agreement.

3.3. Territory: Republic of Kazakhstan and other countries where the app operates on your device.

3.4. No fee for use under this Agreement. Other uses require a separate agreement.

3.5. Intellectual property remains with the Company; no exclusive rights transfer to the User.

3.6. Ensure sufficient device storage before download.

3.7. Using the app means you have read and accept this Agreement.

You may install on unlimited personal devices in the original store-distributed form and use available features and updates as released.

4. Official Rules of Use

4.1. Exclusive rights to the app and databases belong to the Company.

4.2. Right to use starts upon installation via the app store.

4.3. Internet access is required; you bear connectivity costs.

4.4. Technical data (device MAC/ID, usage stats, service information) may be sent automatically without personal linkage.

5. Restrictions

5.1. Without written consent you may not:

- transfer rights to third parties;

- modify, create derivatives, decompile, reverse engineer, bypass security, or recover source code (unless allowed by law);

- remove or alter notices of the Company’s rights.

6. Development and Availability

6.1. The Company may change or discontinue the app without notice.

6.2. Access may be suspended for maintenance.

6.3. The app is provided “as is”; no warranties of uninterrupted, error-free operation or fitness for your purposes.

6.4. Beta versions may be offered for testing without obligation to release a final version.

6.5. Testing is voluntary and not compensated.

7. Other

7.1. Agreement term: 12 months, auto-renews for 12 months unless either party objects 30 days before expiry.

7.2. License term equals the Agreement term; when it ends, usage rights end.

7.3. You may stop at any time by deleting the app.

7.4. The Company is not liable for losses from use or inability to use the app.

7.5. Governing law: Republic of Kazakhstan.

7.6. We may amend the Agreement; changes take effect on publication unless stated otherwise.

7.8. Use the app only for its intended purpose.
